EU Law To Force Compulsory Vehicle Insurance For All Vehicles Including Golf Buggies And Dodgems

The latest news doing the rounds in the insurance market is about the EU government planning to pass laws that may implement full insurance for ‘all’ vehicles. When we say all, it means even those vehicles that never leave private land like Fairground dodgems and children’s ride-on cars. If implemented, this would be one of its kinds of laws that would affect all kinds of vehicles including mobility scooters, golf buggies, ride-on lawnmowers and Segway personal transporters.

The government hinted that the directive may also impact the statutory off-road notification scheme that permits motorists to park uninsured cars on the driveways or private plots. The Department of Transport, EU confessed that the reforms can prove very costly to the drivers and are quite uncomfortable for one and all. Although, people have to oblige to the rules, a consultation would be made open until March.

A consultation was published on 20th Dec 2016 amidst the outrage of the UK ministers who could not agree to the fact that the rule needs to be followed by UK citizens as well. As per the consultation the Department of Transport agreed on the compulsion of the rule until Britain leave the EU by 2019. DoT also said that due to the complexity of the law, there are chances that it may never get implemented. However, if it gets implemented by any means then there would be a ‘sunset clause’ which would abolish the law once Britain splits from the EU.

Such a strict law was formulated after a law case in which a Slovenian was hit by a reversing tractor. As the incident took place on private property and the vehicle fell under the category of agricultural machine, the motor insurance providers refused to cover the claim. It was then that the European Court of Justice decided in favour of the need of compulsory vehicle insurance. This is a clear indication that motor insurance is required for all kinds of vehicles which includes those that are used at places other than roads.

The document published by the Department of Transport says that “This would result in us broadening our definition of a motor vehicle . . . and extending our insurance requirement beyond roads and other public places. This could mean users of motor vehicles would be required to have third-party insurance on private land.”

The government made it clear that some of the vehicles that could face the compulsion of buying a motor insurance include electrically assisted pedal cycles, construction vehicles, agricultural vehicles, engineering plant, quad bikes, motor sports vehicles, mobility scooters, golf buggies, motorised ride-on children’s toys, fairground rides, forklift trucks, dumper trucks, Segways and ride-on lawnmowers.

A spokesperson from the Department of Transport expressed the department’s unwillingness to obey the law by saying that “Following a European Court of Justice Judgment, we are consulting whether to extend motor insurance for private land and other vehicle types.

“We oppose any measures which impose an unreasonable burden on the public. We will use the consultation responses to get the best result for the country.”

This can be a big issue for the British drivers and they must wait for the government to take some concrete measures to stop imposition of such a law. However, as of now we can just wait and watch!
